HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7747 of 2015 ORDER :

This Criminal Petition is filed by the petitioner/ accused in C.C. No.1384 of 2014 on the file of Additional Judicial Magistrate of First Class, at Sangareddy, Medak District, where the learned Magistrate has taken cognizance for the offence punishable under Section 138 of N.I Act, which is outcome of private complaint of 1st respondent herein and issued summons.

2) Heard learned counsel for the petitioner/ accused and also 2nd respondent-State before admission and before ordering notice to 1st respondent-de complainant. Perused the material on record.

3) It appears despite summons served, accused failed to attend to trial Court on 03.06.2015 i.e., the date of hearing fixed. It is issuance of NBW the petitioner approached this Court. In fact there is no illegality or irregularity in the docket order of the lower Court impugned herein. The Criminal Petition is therefore, disposed of, directing the petitioner to appear in person with application under Section 70 (2) Cr.P.C before the trial Court with notice to complainant and the additional public prosecutor concerned and in such an event, the learned Magistrate shall hear and issue warrant under Section 88 Cr.P.C for future appearance.
