HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 27048 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 13.07.2018 in O.A.No. 1367 of 2018 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby the application filed by the petitioners under Section 19 of the Administrative Tribunals Act, 1985, has been dismissed. Having heard the learned counsel for both the parties and with their consent, the writ petition is take up for disposal at the admission stage.

A perusal of the impugned order reveals that the learned Tribunal has dismissed the O.A. observing that when the deployment of the posts was ordered for revamping or restructuring or reorganizing the institutions in the Animal Husbandry and Dairy Development Department, for the purpose of increasing State GVA to Rupees One Lakh Crores, the Tribunal does not find any reason to interfere with the process.

Since the Government issued orders in G.O.Ms.No.28, dated 05.07.2018 regarding redeployment of posts & personnel for effective utilization of services to provide better service delivery to the farmers, this Court is not inclined to

SKK,J & AKS,J WP_27048_2018 render any contrary opinion to this G.O., but of the considered opinion that the case of the petitioners should be considered without disturbing the benefits to be provided by virtue of G.O.Ms.No. 28, dated 05.07.2018.

In view of the above, the petitioners are given liberty to make a representation to the respondents, and on such representation being filed, the respondents shall decide the same, in accordance with law, within a period of two weeks from the date of receipt of the representation and without infringing the principles of natural justice. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
