When the matter was listed on 31.07.2017, there was no representation for the appellant and, therefore, Registry was directed to list the matter under the caption 'for dismissal'. Even on 01.08.2017, there was no representation for the appellant and, as such, the matter was directed to be listed on 08.08.2017 under the same caption. However, on 08.08.2017, there was representation on behalf of the appellant seeking adjournment and, accordingly, the Registry was directed to list the matter today under the same caption. Today, despite the matter being listed under the caption 'for dismissal', there is no representation for the appellant. It shows that the appellant is not interested in prosecuting the appeal. Hence, the present appeal stands dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed.
