THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.24695 of 2016 ORDER:

This Writ Petition is filed for the following relief: "......to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent No.2 in payment of award amount to the petitioners in respect of acquired land in Survey No.110/A of Dahegaon Village & Mandal, Adilabad District and further action of payment of the award amount entitled by the petitioners to respondent Nos.3 and also proceeding to pay the amount in favour of Respondent No.4 is arbitrary and illegal and consequently direct respondent No.2 to pay the award amount to the petitioners in respect of an extent of Ac.2-30 cents in Survey No.110/A situated at Dahegaon Village & Mandal, Adilabad District by duly recovering the same from Respondent No.3 and pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

When the matter is taken up for hearing, learned counsel for the petitioners submits that he may be permitted to withdraw the writ petition with a liberty to the petitioner to approach the authorities concerned.

Recording the said submission, the petitioner is permitted to withdraw the writ petitioner with a liberty to the petitioner to approach the authorities and raise the objections in terms of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013 (in short "the Act"), specifically setting out before the Land Acquisition Officer about their right and title for claiming the compensation in preference to respondents 3 and 4; as and when such application is made the same shall be considered and the Land Acquisition Officer shall pass orders in terms of Section 15 of the Act.

Accordingly, this writ petition is dismissed as withdrawn. There shall no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall

also stand dismissed.
