THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.8292 OF 2015 O R D E R :

This writ petition is filed for a Writ of Mandamus declaring the action of the respondents in refusing to receive and process application for building permission to an extent of 197.00 sq.yards equivalent to 169.69 sq.meters and to an extent of 58.33 sq.yards equivalent to 218.64 sq.meters situated at Noor Khan Bazar, Hyderabad as it is not accompanied with Town Survey Land Record Certificate (TSLR) and No Objection Certificate (NOC), as illegal and arbitrary and for a consequential direction to receive and process the application for building permission without insisting for TSLR and NOC. Today, when the matter is taken up for hearing, it is stated by the learned counsel for the petitioners that the subject matter of the writ petition is squarely covered by the order dated 22.01.2015, passed by this Court in W.P.No.766 of 2015 and the same is not disputed by Sri C.Damodar Reddy, learned Standing counsel for the respondent-Corporation.

For the reasons alike in the above writ petition, this writ petition is disposed of directing the respondents-GHMC to take an appropriate decision on the application made by the petitioners seeking permission for construction of building, in accordance with the provisions of the Hyderabad Municipal Corporation Act, 1955 and the Building Rules and Regulations made there under, without insisting for production of TSLR certificate and No Objection certificate from the Revenue authorities. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
