2016-02-18Vilas V.Afzulpurkar4 pages

THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.5213 OF 2016 ORDER:

Heard.

The petitioner seeks expeditious hearing and disposal of the succession proceedings pending before the 2nd respondent. It is stated in the affidavit that the brothers of the petitioner filed application seeking succession of the property of Smt S.Yadamma W/o late Srinivasulu.

The said proceedings are numbered as A/ROR/330/2015 and the 2nd respondent has already issued notice to the legal heirs of late S.Ramulu including the petitioner herein. The petitioner states that she has already filed objections on 11.08.2015 and also a separate application on the same day seeking succession.

Learned counsel for the petitioner seeks that both the applications may be heard and disposed of together, so that the dispute relating to succession will get resolved. It is evident that two different applications for succession were pending and they are required to be taken up and adjudicated by the 2nd respondent after notice and hearing of all the parties. Since the 2nd respondent has already stated to have issued notice in the applications referred to above, he shall examine the application filed by the petitioner and if it is otherwise in order, follow due procedure by issuing notice, hearing the parties and decide the applications expeditiously preferably within a period of three months from the date of receipt of a copy of this order. With the above observation, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
