THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No.1221 of 2006 JUDGMENT: (per the Hon'ble Sri Justice Dilip B.Bhosale) Learned counsel for the appellant, in view of the fact that the appellant is completing 58 years of age, does not press this appeal and seeks liberty to the appellant to approach the Government by way of a representation for appropriate relief and prays for continuing the interim protection granted by this Court, vide order dated 20.011.2006, pending the hearing and final disposal of the appeal, till the end of February, 2015. By virtue of the order, dated 20.11.2006, the appellant is still in service.

2. We accordingly dispose of the Writ Appeal as not pressed. It is open to the appellant to approach the Government by way of representation for seeking appropriate relief. If any such representation is made, we hope and trust that the same shall be considered by the Government in accordance with law, as expeditiously as possible, preferably before the end of February, 2015.

While making this observation, we shall not be understood to have issued any direction as such to the Government either in favour or against the appellant. We further make it clear that we have not examined the appellant's right to seek any relief by way of representation.

3. Till the end of February, 2015, the appellant is allowed to work on the post on which he has been working by virtue of the order dated 20.11.2006 passed by this Court. It is made clear that no further extension shall be granted by this Court. However, this shall not

preclude the appellant from seeking appropriate relief from the Government. If any such prayer is made, we observe that it shall be considered in accordance with law. Miscellaneous petitions pending, if any, stand disposed of.
