Heard.

The grievance of the petitioners is with regard to non-consideration of their application for grant of ryothwari patta and it is stated to be pending with the Joint Collector, Anantapur, vide SR.No.45/40/11(a)/69 ATP. The petitioners state in the affidavit that they have filed the said application long back and while notices were issued way back in the year 1977, subsequently the file itself is not traceable, as is evident from the endorsement of the office of the Collector, Anantapur, in Lr.Per.No.8057/F.2/2014, dated 28-10-2014. Complaining inaction on the part of the 2nd respondent in tracing out the file and non-consideration of the said application, the petitioners filed the present writ petition.

On 10-08-2015, at the request of the learned Government Pleader, four weeks time was granted for tracing out the file and for getting instructions. A counter affidavit has since been filed by the 2nd respondent specifically mentioning that the said file has been traced out and action is being taken to finalize the issue after receipt of report from the Estate Manager.

Since the file is now traced and is available with the 2nd respondent, the grievance of the petitioners survives only to the extent of consideration of their application and passing appropriate orders thereon by the 2nd respondent.

Hence, the writ petition is disposed of directing the 2nd respondent to fix an early date of hearing in the said application of the petitioners and after considering the aforesaid file, report of the Estate Manager and other relevant record, take appropriate decision in accordance with law expeditiously. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
