THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26998 of 2018 ORDER:

Heard learned counsel for the petitioner and Smt.Pingali Lakshmi, learned Standing Counsel for the second respondentGWMC. According to the learned counsel for the petitioner, petitioner herein submitted an explanation to the notice, dated 30.06.2018, issued under Sections 452 (1) and 461 (1) of the Hyderabad Municipal Corporation Act, 1955 (for brevity, 'the Act'), and, without considering the same, the impugned notice was issued, under Section 452 (2) of the Act. The same is disputed by the learned Standing Counsel by stating that no such explanation was received by the second respondent-GWMC so far. In view of the above, and, in order to have a quietus, this Court deems it appropriate to dispose of the Writ Petition, permitting the petitioner herein to submit an explanation afresh to the notice, dated 30.06.

2018, and the present notice, dated 27.07.2018, within a period of one week from the date of receipt of a copy of this order, and, if any such explanation is submitted, the same be considered and appropriate final orders be passed by the second respondent-GWMC, strictly in accordance with law. Till then, no coercive action shall be taken by the respondents against the subject constructions.

Accordingly, Writ Petition is disposed of. There shall be no order as to costs.
