Yanamala Sreenivasulu, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14088 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.
2. This writ petition is filed challenging the order of suspension of authorization pending enquiry passed by the 3rd respondent on 25.04.2015. A reading of the impugned order shows that the Civil Supplies Deputy Tahsildar, Kaligiri, submitted a report, pursuant to the inspection held on 19.04.2015 in respect of a fair price shop run by the petitioner in L.R. Agraharam Village, Jaladanki Mandal. It was further stated in the impugned order that some irregularities were noticed in the distribution of essential commodities and hence the authorization of the petitioner was suspended pending enquiry. Since it is an order of suspension pending enquiry, this Court is not inclined to admit the writ petition at this stage and an opportunity is given to the petitioner to submit his explanation within a period of 15 days from the date of receipt of a copy of this order and the 3rd respondent shall conduct an enquiry into the irregularities alleged against the petitioner within a period of 60 days from the date of receipt of the explanation and pass final orders thereon.
3. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 2nd June, 2015 cbs
