THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2891 of 2016 ORDER:

The present application is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of all further proceedings in C.C.No.160 of 2015 on the file of the Special Mobile Judicial First Class Magistrate, Kakinada. A private complaint came to be filed against the petitioner for an offence punishable under Section 138 of the Negotiable Instruments act, 1881.

Though the present application is filed seeking quashing of all further proceedings, but the learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court.

Having regard to the nature of allegations made and taking into consideration the facts and circumstances of the case, the presence of the petitioner in C.C.No.160 of 2015 on the file of the Special Mobile Judicial First Class Magistrate, Kakinada, is dispensed with except on the dates when his presence is specifically required by the Court.
