HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21010 OF 2016 ORDER:
The case of the petitioners is that they were issued notices under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 (for short 'the Act') on 04.06.2016 in RC.No.B/168/2016 by the 4th respondent, insisting the petitioners to vacate their respective lands in total admeasuring Ac.52.22 guntas covered by Sy.No.265 situated in Akinepalli Revenue Village, Dammapet Mandal, Khammam District. In pursuance to the said notice, the petitioners submitted their objections on 06.06.2016. But the respondent authorities without passing any orders under Section 6 of the Act are trying to dispossess the petitioners. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.
Since it is stated that the petitioners have already filed explanation on 06.06.2016, it is for the 4th respondent to pass orders. In view of the same, the 4th respondent is directed to pass orders in pursuance to the explanation submitted by the petitioners within a period of eight
(8) weeks from the date of receipt of copy of this order. Till such time, status-quo obtaining as on today shall be maintained in respect of the lands which are in possession of the petitioners.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 29-06-2016 dv
