THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 34040 of 2016 ORDER:
It is the case of the petitioner that his grandfather worked as Coal Filler in Boyepalli-I Incline, Bellampalli Area of respondentCompany. Since he was not medically fit, he stopped to attend his duties and he was declared medically unfit as on 01.08.1977. Thereafter, he died.
The father of the petitioner made a request for appointment under 'Dependant Employment Scheme' and now he attained the age of 58 years. The petitioner is the grandson and he submitted an application on 25.06.2014 requesting to consider his case for appointment under 'Dependant Employment Scheme'. When the application of the petitioner was not considered, the petitioner filed W.P.No.41823 of 2015 and this Court disposed of the same on 23.12.2015 directing the respondent-Company to consider the representation, dated 25.06.2014. Thereafter, an order was passed by respondent No.2 rejecting his request by order, dated 17.03.2016. Challenging the same, he filed the present writ petition. Learned counsel for the petitioner submits that though the petitioner challenged the order, dated 17.03.2016, the compensation amount payable to his grandfather was not paid and if the said
amount is paid, he will not press for appointment under 'Dependant Employment Scheme' in view of the order of rejection. In the circumstances, the writ petition is disposed of directing respondent Nos.2 and 3 to pay the compensation either to the petitioner or to his father, consequent to the declaration of his grandfather as medically unfit and his subsequent death, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
