HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.12238 of 2013 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for respondent Nos.1 to 3.

The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in calling the petitioner to the police station and harassing the petitioner and demanding an amount of Rs.2 lakhs, is illegal, arbitrary and violation of principles of natural justice. Consequently direct the respondents not to harass the petitioner and pressurize the petitioner for fulfillment of illegal demands of the 4th respondent."

During the course of hearing, learned Government Pleader brought to the notice of this Court that the petitioner's son by name Hamsabargula Pallalu @ Kumar involved in four criminal cases and the same were ended in acquittal. As far as Crime No.13 of 2013 for the offences under Sections 395, 420 and 323 read with 34 IPC is concerned, it is under investigation and the petitioner's son being A1 is absconding. Sincere efforts are being made to arrest him and recover the property. It is specifically contended that the respondent police never harassed the petitioner, including the locality people of drivers' colony of Gokavara Village, and never demanded to give the stolen properties. It is specifically denied that the respondent police demanded Rs.2 lakhs from the petitioner and her son to

delete his name in Crime No.13 of 2013. Except registering the crime against the petitioner's son, the respondent police have not harassed, threatened and interfered with the life and liberty of the petitioner and her son.

Taking into consideration the said contentions, this Court is of the opinion that no further orders are required in the writ petition.

Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 27.11.2018.
