HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.16009 OF 2009 ORDER:
This Writ Petition is filed to direct the respondent Nos. 1 to 3 not to assign or grant pattas in the petitioner's land bearing Sy. No.52 admeasuring to an extent of Ac.19.16 gts situated at Ruydi village, Talamadugu Mandal, Adilabad District in favour of third parties pending disposal of the statutory appeal on the file of the 1st respondent which is stated to have been filed by the petitioner and his brothers on 17.11.2007 against the judgment of the Special Deputy Collector (Tribal Welfare), Utnoor, Adilabad District in Case No.TWA2/45/2002 dated 24.09.2003.
Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Social and Tribal Welfare. It is submitted by the learned counsel for the petitioner that this Court had granted status quo order on 06.08.2009, having regard to the pendency of the statutory appeal before the 1st respondent authority since 17.11.2007. Today, when the matter is taken up for hearing, learned Counsel for the petitioner and learned Assistant Government Pleader for Social and Tribal Welfare, would submit that the outcome of the said appeal filed before the 1st respondent authority is not known. Accordingly, it is submitted by the learned counsel
for the petitioner that since a stay has been granted by this Court and has been operating all through till date, the petitioner's interest be protected, while directing the 1st respondent to dispose of the appeal.
Having regard to the said submission made on either side, this Court is of the view that this Writ Petition can be disposed of by directing the parties to maintain status quo as per the interim order of this Court dated 06.08.2009 till the disposal of the appeal filed before the 1st respondent on 17.11.2007, if not already disposed. The 1st respondent authority is hereby further directed to dispose of the appeal within a period of three months from the date of receipt of a copy of this order, if not already disposed of. With the above direction, the Writ Petition is closed. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
