HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39300 OF 2014 ORDER :

This writ petition is filed for a writ of Mandamus declaring the inaction of the respondents 1 to 3 as illegal and arbitrary and consequently to direct the respondents 1 to 3 to take action against 4th respondent as per the A.P.Gram Panchayat Building Rules, 2002 and demolish the unauthorized structure.

Since the permission granted to the 4th respondent was cancelled by proceedings of the 3rd respondent dated 01.11.2014 and the same was set aside in W.P.No.3029 of 2015 today, in view of violation of principles of natural justice, as the same was issued without issuing any prior notice to the 4th respondent and W.P.No.3029 of 2015 was disposed of directing the 3rd respondent Grampanchayat shall issue fresh notice to the 4th respondent (petitioner therein) before taking action for demolition of unauthorized structures and take action as per law, no further orders are required to be passed in this writ petition.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
