Respondent Counsel for the appellant : Sri M.S.N.Prasad Counsel for the respondent : Sri P.Srinivas THE COURT MADE THE FOLLOWING COMMON JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This appeal is filed by the wife of the respondent feeling aggrieved by decree of divorce dated 28-12-2007 in F.C.O.P.No. 497 of 2005 on the file of the Judge, Family Court, Hyderabad.

The appellant has filed F.C.A.M.P.No. 100 of 2016, wherein it is stated that she and the respondent have filed a memorandum of compromise dated 11-02-2016 under Order 23 Rule 3 of the Code of Civil Procedure inter alia stating that on the advice of elders of both the families, friends and relatives, both of them have decided to lead their marital life and, accordingly, they have been living together happily along with their only child Sai Karthik since April, 2010.

Both parties are personally present in the Court and they have

confirmed the contents of the memorandum of compromise. 4.

In the light of the above, decree dated 28-12-2007, assailing in F.C.A.No. 10 of 2008, is set aside. Both F.C.A.M.P.No. 100 of 2016 and F.C.A.No. 10 of 2008 are, accordingly, allowed.

5. As a sequel to disposal of F.C.A.No. 10 of 2008, F.C.A.M.P.No. 19 of 2008 shall stand closed as infructuous.
