HON'BLE SRI JUSTICE M.S.K. JAISWAL ORDER:

This is a Transfer Criminal Petition filed, under Section 407 Cr.P.C, seeking to transfer C.C. No.1779 of 2006, presently pending on the file of the Court of Judicial First Class Magistrate, Jangareddygudem, West Godavari District, to the Court of Assistant Sessions Judge, Kovvur, West Godavari District, to be tried along with S.C. No.236 of 2008, which is pending on its file. 2 . Even though it is contended that both the cases are in respect of the same property, but it is conceded that both the cases do not arise out of the same transaction, therefore, the question of C.C. No.1779 of 2006 being treated as counter case to the Sessions Case No.236 of 2008 does not arise. However, it is submitted that originally the present C.C.

was on the file of II Additional Judicial Magistrate of First Class, Kovvur, and on the inception of new Court at Jangareddygudem, this C.C has been transferred, and it would be convenient for both the prosecution and the accused if this case is also tried by the Court of II Additional Judicial Magistrate of First Class, Kovvur, where the Sessions Case is already pending.

3. Considering the above submissions, it is directed that C.C. No.1779 of 2006, on the file of the Court of Judicial First Class Magistrate, Jangareddygudem, West Godavari District, be transferred to the Court of II Additional Judicial Magistrate of First Class, Kovvur.

4. Accordingly, the Transfer Criminal Petition is ordered. As a sequel, miscellaneous applications, if any, pending in this Transfer Criminal Petition shall stand closed.
