THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10360 of 2007 ORDER:
Heard Sri A.K.Jaya Prakash Rao, learned counsel for the petitioner, learned Government Pleader for Labour for the 1st respondent and Sri B.G.Ravinder Reddy, learned counsel for respondents 2 and 3.
The petitioner prays for Mandamus declaring inaction of the 3rd respondent in not raising the attachment of materials and bank accounts, pursuant to the order dated 09-03-2007 in W.P.No.4817 of 2007, as illegal and unconstitutional.
This Court on 16-05-2007 directed the 3rd respondent to raise the attachment of materials and bank account in terms of the order in W.P.No.4817 of 2007, dated 09-03-2007.
Paragraph No.6 of the counter affidavit of the 2nd respondent reads thus:- "It is submitted that the W.P.No.4817/07 was disposed of directing the petitioner to approach the E.I.Court and to deposit 50% of the amount demanded. The petitioner filed E.I.Case No.12/07 and the same is pending before the E.I. Court. The allegation that the attachment order was not lifted is not correct. The attachment order was lifted on 12.06.07." Having regard to the above circumstances, no further order is necessary.
Accordingly, the writ petition is disposed of. No order as to costs.
