This writ petition is filed challenging the order in proceedings No.A1/1592/2017, dated 20-07-2017 by which the petitioner was suspended pending enquiry by the 3rd respondent.
Learned counsel for the petitioner says that as per rules, it is the 2nd respondent who is competent authority to initiate action against the petitioner.
Heard learned Assistant Government Pleader for Services, who could not dispute the contention of learned counsel for the petitioner.
As per rule 13 of Telangana State Civil Services (CCA) Rules, 1991, the 3rd respondent is not the competent authority, but the 2nd respondent is competent authority to initiate action.
In view of the same, the impugned order is set aside. However, it is open for the competent authority to take appropriate action in accordance with law.
Accordingly, the writ petition is allowed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
