THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.41237 OF 2016 ORDER:

This Writ Petition is filed with the following prayer: ".. to issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions to direct the 2nd and 3rd respondents to act in accordance with law and not to interfere with the business of the petitioners as dealers in seeds under the provisions of Seeds Act, 1966 and the Rules framed thereunder in accordance with the license held by them as on 15.10.2016 subject to the conditions as imposed by the Hon'ble Court in W.P.Nos.37728, 37736 and 37767 of 2016 dated 15.11.2016, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioners submits that earlier petitioners approached this Court in W.P.No.38317 of 2016 and batch challenging the cancellation of licences granted to them and this Court, by order, dated 08.11.2016, disposed of the Writ Petitions directing respondent No.2 to pass orders on or before 12.11.2016 in pursuance of the show-cause notice, but no orders are passed yet and as the petitioners are not allowed to do business, they have filed the present Writ Petition. He also submits that pending this Writ Petition, order, dated 07.12.2016, was passed confirming the earlier order of cancellation and that the said order is not in consonance with the directions issued by this Court in the earlier batch of Writ Petitions.

3. Learned counsel representing learned Additional Advocate General submits that the respondents passed orders after considering the case of the petitioners and the relief sought for in the present Writ Petition cannot be granted, as the licenses of the petitioners were already cancelled.

The grievance of the petitioners is that without passing any orders pursuant to the orders passed by this Court in earlier batch of Writ Petitions, the respondents are not allowing the petitioners to do business. But, now order, dated 07.12.2016, is passed. Without challenging the said order, the relief sought for in this Writ Petition cannot be granted. In view of the same, I find no ground to grant the relief sought for in this Writ Petition.

5. Accordingly, the Writ Petition is dismissed. However, it is open to the petitioners to challenge the proceedings, dated 07.12.2016. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 15, 2016.
