The Court made the following:

WRIT PETITION No. 9946 of 2015 ORDER:

Case of the petitioners is that they are in occupation and enjoyment of the land to an extent of o.o4 cents each out of Ac.2.75 in Survey No. 291 of Upparapalem village, hamlet of Vankayalapadu Grampanchayat, Yedlapadu mandal, Guntur district and living therein by constructing houses decades back. While so, respondent authorities sought to dispossess the petitioners on the alleged ground that they have encroached into the government land.

Hence, this writ petition.

2. Counter affidavit filed by Gram Panchayat. In para 5 of the counter affidavit, it is categorically asserted that grievance cell of the Gram Panchayat received a complaint of encroachments made by petitioners and in order to verify the ground scenario, the Secretary of the Gram Panchayat has visited the spot. The deponent categorically states that there is no threat of dispossession and before taking any action, the Gram Panchayat will fallow due procedure as contemplated by law. In the circumstances recording the statement made by the Panchayat Secretary in the counter affidavit, the writ petition is disposed of. No costs. Having regard to the same, all old miscellaneous petitions are closed.
