THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No. 4484 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The State of Andhra Pradesh and the Engineer-in-Chief (Administrative Wing), Irrigation and CAD, filed this writ petition aggrieved by the order dated 23.04.2013 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1974 of 2010. The said O.A. was allowed in part by the Tribunal confirming the punishment of 2% permanent cut in pension imposed upon the first respondent and also the treatment of the period of suspension undergone by him as leave eligible under F.R. 54-B(7). The authorities were however directed to release the annual grade increments for the period of suspension notionally for the purpose of seniority, pay fixation and pensionary benefits and pass appropriate orders for releasing the annual grade increments notionally.

Learned Government Pleader for Services (Andhra Pradesh) would state that this writ petition was filed as the first respondent initiated contempt proceedings before the Tribunal without taking necessary steps pursuant to the order passed by the Tribunal, including the furnishing of a consent letter. Sri Ch. Ganesh, learned counsel for the first respondent, stated that his client furnished his consent letter dated 26.03.2016 but despite the same no orders have been passed till date. Learned Government Pleader would state that in the light of the consent letter having been furnished, the cause in this writ petition does not survive for consideration and appropriate action

would be taken upon the consent letter dated 26.03.2016 in terms of the directions of the Tribunal.

The Writ Petition is accordingly disposed of directing the authorities to take appropriate action in terms of the order passed by the Tribunal after considering the consent letter dated 26.03.2016 furnished by the first respondent. This exercise shall be completed expeditiously and, in any event, not later than four weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
