THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.1396 OF 2017 ORDER:

Heard. With the consent of learned counsel for the parties, this Writ Petition is being disposed of at the stage of admission. 2.

This Writ Petition is filed for the following prayer: "... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein more particularly the 1st respondent herein in not reappointing/continue the petitioner in service as ANM/MPHA[F] in pursuance to the Government Memo No.17040/7/2016-G-HM&FW, dated 21.04.2016, and consequential proceedings issued by the 2nd respondent vide Rc.No.468/USP.B/2010, dated 26.04.2016, and Rc.No.468/USP.B/2010, dated 07.05.2016, as highly illegal, arbitrary and consequentially, this Hon'ble Court may be pleased to declare that the petitioner herein is entitled for reinstatement/continue into service as MPHA (F)/ANM on outsourcing basis as per the Government Memo No.17040/7/2016-GHM&FW, dated 21.04.2016, and consequential proceedings issued by the 2nd respondent vide Rc.No.468/USP.B/2010, dated 26.04.2016, and 07.05.2016 and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."

When the matter is taken up for consideration, having regard to the issue involved in the Writ Petition, learned counsel for the petitioner fairly submits that the petitioner would be satisfied, if a direction is issued for consideration of her case for appointment as ANM under the National Rural Urban Health Centre Scheme (for short 'the Scheme') as and when there is such

a requirement in Guntur District on par with all other eligible candidates.

Having regard to the said submission, the Writ Petition is disposed of directing respondents 4 and 5 to consider the entitlement of the petitioner for appointment as ANM along with all other eligible and suitable persons as and when such appointments are taken up under the Scheme. There shall be no order as to costs.

Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
