J.Ramanamma v. State Of Andhra Pradesh, Rep. By Its Principle Secretary,
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 4978 of 2015 Date of Judgment: 15.4.2015 Between:
J. Ramanamma
...Petitioner
And State of Andhra Pradesh and others ..Respondents THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 4978 of 2015 ORDER:
Heard learned counsel for the parties.
The petitioner questions the order of her removal as Mid-day meal agency, dated 12.2.2015 passed by the fourth respondent. The impugned order states that after reviewing the earlier orders and in terms of the directions of this Court in W.P.No. 9800 of 2013 and batch, dated 30.12.2014, the order of removal was once again passed. But the impugned order does not show that the petitioner was given a notice or an opportunity to explain any circumstance against her and straightaway the order of termination was passed.
The impugned order is not in conformity with the directions of this Court in W.P.No. 9800 of 2013 and batch, dated 30.12.2014. Hence the writ petition is allowed, the impugned order is set aside and the matter is remitted back to the fourth respondent to scrupulously follow the directions of this Court in W.P.No. 9800 of 2013 and batch, dated 30.12.2014 and take appropriate decision in the matter expeditiously. Miscellaneous applications, if any, shall stand closed. No order as to costs.
