Bhosale) Mr. Rajani Kanth Jwala, learned counsel for the petitioner submits that in view of the interim order dated 20.11.2008, passed in W.P.M.P. No. 33317 of 2008, nothing further survives in the writ petition and he prays for disposal of the writ petition with direction to the 1st respondent to hold an enquiry as contemplated under the provisions of the Motor Vehicles Act, 1988 (for short 'the Act').

The writ petition is disposed of as rendered infructuous. This, however, shall not preclude the concerned authority from holding an enquiry as contemplated under the provisions of the Act. As prayed for, hearing and conclusion of the enquiry is expedited. Consequently, pending miscellaneous applications shall also stand closed. No costs.
