HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos.12337, 12341 and 12343 of 2017 Common Order:
These Writ Petitions are filed challenging the individual orders of eviction passed in exercise of powers conferred under Sub-section (2) of Section 5 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, as amended by Amendment Act, 1980.
The orders were passed on 13.03.2017 in respect of petitioners. Since there is a provision for appeal against the impugned orders, this Court is not inclined to entertain the present Writ Petitions, but gives liberty to the petitioners to approach the concerned appellate authority within a period of thirty (30) days from today. In view of the liberty granted to the petitioners to approach the concerned appellate authority, the petitioners shall not be evicted for a period of forty five (45) days and if the petitioners do not file an appeal within thirty (30) days, it is open to the respondents to take appropriate action in accordance with law. The Writ Petitions are, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
