THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7679 OF 2016 ORDER:
This petition is filed by the petitioner-accused seeking to relax the condition imposed by the I Additional Chief Metropolitan Magistrate, Visakhapatnam, vide order dated 12.1.2016 in Crl.M.P.No.196 of 2016 in Crime No.202 of 2016. The learned Additional Public Prosecutor opposed this petition. While granting bail to the petitioner, the learned Magistrate imposed conditions directing him to execute a bond for a sum for Rs.25,000/- with two sureties for a like sum each, and to appear before the Station House Officer concerned on every alternate day in between 12.00 to 1.00 p.m., till the charge sheet is filed. Subsequently, on the applications filed by the petitioner, the said condition of appearance of the petitioner before the Station House Officer concerned was relaxed for limited period.
Now, the petitioner prayed for relaxing the said condition of appearance before the Station House Officer concerned. Considering the facts and circumstances of the case and the grounds raised by the petitioner in the petition, the condition imposed by the learned Magistrate directing the petitioner to appear before the Station House Officer concerned on every alternate day is relaxed.
