HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.22846 of 2017 ORDER:

In spite of granting time, the 3rd respondent could not place before the court the stage of the stay petition filed by the petitioner in the appeal filed against the order dated 26.12.2016.

2. The prayer is against inaction of the 3rd respondent in passing the orders on the stay petition filed along with the appeal by petitioner against the order dated 26.12.2016. After perusing the material available on record and hearing the learned counsel, I am satisfied the writ petition can be disposed of by directing the 3rd respondent to take up the stay petition filed along with the appeal on 01.02.2017 and dispose of the stay petition within four months from today, after affording opportunity of hearing to the petitioner.

3. The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
