THE HON'BLE SRI JUSTI CE M.GANGA RAO CONTEMPT CASE No.1095 of 2014 I n W.P.No.25345 of 2005 ORDER:
This contempt case is filed for non-compliance of the order, dated 13.12.2013, passed in W.P.No.25345/2005, wherein this Court directed the respondent bank to consider the cases of the beneficiaries for promotion adding two years of weightage to their service to bring them within the zone of consideration for promotion and decide the promotions on the policy of seniority-cum-merit adopted by the respondent bank. Heard both sides.
Pursuant to the orders of this Court, the three beneficiaries of the petitioner association were given weightage adding two years service to bring them within the zone of consideration and they were allowed to appear for the written test and interview. There were seniors above the said three beneficiaries. Though the beneficiaries reached the bench mark, as per the selection process on the basis of seniority cum merit, they were placed at Sl.Nos.11 to 13 in the seniority list. As per the directions of this Court, the learned counsel for the respondent bank has produced the recommendations of the Interview Committee and list of selected candidates. As seen from the recommendations of the Interview Committee and list of selected candidates, the three beneficiaries of the petitioner association were given weightage of two years in service. The names of three beneficiaries are placed at Sl.Nos.11 to 13 in the list. They being juniors, the three beneficiaries of the petitioner association could not be promoted, in filling up of 7 vacancies, 6 meant for General
MGR,J CC_1095_2014 Category and one meant for SC category. After perusal, these two documents, as produced, are returned to the learned counsel for the respondent bank.
This court found that there is no wilful and deliberate violation of the orders of this court, dated 13.12.2013, passed in W.P.No.25345 of 2005. The contempt case is accordingly dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
