Heard learned counsel for petitioner vis-à-vis learned Government Pleader for Mines representing respondents 1 and 2 and learned Government Pleader for Home representing respondent No.3 and perused the prayer in the writ petition in supporting affidavit and other material on record Including payment of Rs.1,00,000/ - as per G.O Ms.No.42 dated 29.03.2016.
2) The receipt shows treasury/ PAO code as 1116, treasury challan No.0000013333, minor head-102, Sub-head-81, dated 02.06.2017 for Rs.1,00,000/ -.
3) It is the grievance of the petitioner from the prayer in writ petition that despite payment, the vehicle is not released. Whereas learned Government Pleader for Mines submitted that payment has been made and remitted to GAD and the vehicle is under the control of 3rd respondent since the police seized the same through Vigilance Enforcement under the control of GAD. It is further submitted that 2nd respondent addressed a letter dated 02.06.2017 to Vigilance Enforcement Wing about payment of amount and to release the vehicle.
4) Having regard to the above, respondents are directed to release the vehicle to the petitioner through GAD by processing the same and the Principal Secretary, GAD is directed to see that the
vehicle be released within fifteen (15) days from the date of receipt of the order. The copy of this order also be marked to the Principal Secretary, GAD Department.
5) Accordingly, the writ petition is allowed. No order as to costs.
6) As a sequel, miscellaneous petitions if any pending shall stand closed.
