THE HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CONTEMPT CASE No.2340 of 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) This contempt case, under Sections 10 to 12 of the Contempt of Courts Act, is filed alleging that the respondents herein have willfully and deliberately violated the directions issued by this Court in the order dated 28.09.2015 passed in W.P.No.22684 of 2015.
In view of the pendency of I.A.No.1936 of 2015 before the A.P. State Consumer Disputes Redressal Commission, this Court disposed of the aforesaid writ petition directing the State Commission to dispose of the said I.A as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of the order and further directed that till such time, no further steps shall be taken pursuant to the docket order, dated 10.07.2015, passed in FA (SR) No.1474 of 2015 in P.P.No.46 of 2014 in Consumer Complaint No.63 of 2014 on the file of the District Consumer Disputes Redressal Forum-II, Vijayawada.
In this contempt case, it is contended by learned counsel for the petitioners that when FA (SR) No.1474 of was listed on 21.11.2015 before the State Commission, the complainants in Consumer Complaint No.63 of 2014 have taken time to file counter and, as such, it was adjourned to 21.12.2015. It is further contended that
in spite of interim orders passed by this Court, the District Consumer Forum has passed docket order on 18.11.2015, directing to issue N.B.Ws against the petitioners herein, which is contrary to the directions issued by this Court. This Court, in the order dated 28.09.2015 in W.P.No.22684 of 2015, while directing the State Commission to dispose of I.A.No.1936 of 2015 in FA (SR) No.1474 of 2015, ordered that till such time, no further steps shall be taken pursuant to the docket order passed by the District Consumer Forum. As this Court, in the said order dated 28.09.2015, has fixed four weeks' time for disposal of I.A.No.1936 of 2015, it cannot be said that the respondents have willfully and deliberately violated the directions issued by this Court. At the same time, having taken time for filing counter, the complainants ought not to have pressed for the orders during the pendency of I.A.No.1936 of 2015 before the State Commission.
In that view of the matter, we set aside the order, dated 18.11.2015, in P.P.No.46 of 2014 in C.C.No.63 of 2014 passed by the District Consumer Disputes Redressal Forum-II, Vijayawada, and direct the said Forum to defer all further proceedings till disposal of I.A.No.1936 of 2015 pending before the State Commission.
Subject to above, the Contempt Case is disposed of. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
