THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3304 OF 2016 ORDER:

This Criminal Petition is filed by the accused No.1 to 10 under Section 482 Cr.P.C. seeking to quash the proceedings in S.C.No.11 of 2016 pending on the file of Special Court for the cases under SCs and STs (POA) Act-cum-V Additional District and Sessions Judge at Sangareddy.

The grounds now raised by the learned counsel for the petitioners for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings. At this stage, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioner Nos.2 and 10 before the trial Court as they are students. In the result, the Criminal Petition is dismissed. However, the presence of petitioner Nos.2 and 10-A.2 & A.10 before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. They are directed to be represented by a counsel on all hearing dates. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
