THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.11110 & 11126 of 2023 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 and 2 respectively in Crime.No.937 of 2023 on the file of Rajendranagar Police Station, Cyberabad, registered for the offences under Sections 120-B, 302 and 201 r/w. 34 of IPC.

Since the petitioners in both the petitions are accused Nos.1 and 2 respectively in the very same crime, both the petitions are heard together and disposed off by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that a complaint was lodged on 29.08.2023 alleging that the deceased was attacked in front of Celebrity Fitness Studio. The victim was

taken to the hospital with grievous injuries where he was declared dead. In the complaint, it is mentioned that four persons have attacked him with knives. On the basis of the said complaint, the Police identified these petitioners and others as responsible for causing the death of the deceased. 5.

The petitioners are seeking relief of bail on the ground that investigation is complete and charge sheet is already filed. Further, this Court by order dated 18.10.2023 directed release of A-3. Even according to the prosecution, petitioners were not present when the alleged incident had taken place. The only allegation against these petitioners is that they have engaged A-3 and others to attack the deceased. Basing on the confession, the petitioner was implicated in the case, which is inadmissible. 6.

Keeping in view that the petitioner/A-2 is a student and his examinations are scheduled on 06.01.2024 and 07.01.2024 and further the investigation is complete and charge sheet is already filed, the relief of regular bail can be granted to the petitioners, subject to following conditions:-

i) The petitioners/Accused Nos.1 and 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of XI Additional Metropolitan Magistrate, Cyberabad at Rajendra Nagar, Ranga Reddy District.

ii) The petitioner/Accused Nos.1 and 2 after release shall appear before the concerned Station House Officer everyday at 10:00 a.m. for a period of eight weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, these Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
