The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.18351 of 2012 Dated 08.07.2015 Between:

K.Nageswara Rao ... Petitioner and 1.The Govt. of A.P., rep. by the Prl.Secretary, Hyderabad and others.

...Respondents

Counsel for the petitioner: Mr.TC.Krishnan Counsel for Respondent No.1: GP for Land Acquisition Counsel for respondent Nos.2, 6 & 7: GP for Forests Counsel for respondent Nos.3 to 5, 8 & 9: GP for Revenue The Court made the following:

Order:

This Writ Petition is filed for a Mandamus to declare Gazette Notification No.528, dated 14-09-1954, including an extent of Acs.12-07 guntas in Survey No.25 of Timmayapalli Village of Doma Mandal, Ranga Reddy District, in Rangampalli Reserve Forest Block, as illegal and arbitrary.

Curiously, having ventured to question the abovementioned notification, the petitioner has not filed the same, without which the Writ Petition cannot be adjudicated.

Mr.T.C.Krishnan, learned Counsel for the petitioner, having realized the inherent defect from which the Writ Petition suffers, requested for permission of the Court to withdraw the Writ Petition with liberty to his client to file a fresh Writ Petition by filing the Gazette notification, on all legally permissible grounds. The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.23499 of 2012, filed by the petitioner for interim relief, is dismissed as infructuous.
