It is represented by the learned counsel for the appellant that the matter has been settled between the parties out of Court, and in pursuance thereof a sum of Rs.40,00,000/ - has been paid by the 1st respondent to the appellant. In view of the said settlement between the parties, the learned counsel for the appellant submits that he do not intend to press the appeal.
