JUDGMENT

None appears for the appellant as well as the respondents. This Civil Miscellaneous Appeal is directed against the order dated 3.3.2010 passed in I.A.No.2197 of 2009 in O.S.No.107 of 2009 by the II Additional District Judge, Vijayawada. The plaintiff filed the said suit for specific performance of the agreement of sale deed dated 15.03.2009 and for cancellation of sale deed dated 29.4.2009. Along with the suit, the plaintiff filed I.A.No.2197 of 2009 seeking temporary injunction against the respondents-defendants from making any structures in the plaint schedule property and the same was allowed on 3.3.2010. Aggrieved by the same, the present appeal is filed. This Court by order dated 18.08.2010 granted interim stay and the same has been continuing till date.

In view of the same, if O.S.No.107 of 2009 is not yet disposed of, the II Additional District Judge, Vijayawada, is directed to dispose of the same as expeditiously as possible , but not later than six months from the date of receipt of a copy of this

order and the status quo prevailing with regard to construction of structures shall be continued till the disposal of the suit. Accordingly, the Civil Miscellaneous Appeal is disposed of. No costs.
