THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13889 of 2017 ORDER:

This Writ Petition is filed challenging the action of the second respondent in trying to arrest the petitioner even though her name is not mentioned in the FIR No.15 of 2017, dated 22.02.2017.

Learned Counsel for the petitioner submits that as per the complaint there was a collusion of revenue, agriculture and bank officials in respect of the offence alleged. The petitioner appears to be working as Mandal Agriculture Officer. Whether the involvement of the petitioner is there or not, it is for the investigating officer, and this Court cannot come to a conclusion on the basis of the averments made in the affidavit filed in support of the Writ Petition. However, it is needless to observe that the second respondent shall follow due process of law while conducting investigation. In the circumstances, the Writ Petition is dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 19.04.2017 vs
