This petition is filed for a writ of Mandamus declaring the action of the respondents in forcing the petitioners to vacate the land in Survey Nos.342 and 343 of Sangam Village and Mandal, Nellore District without providing an opportunity for either to file an explanation before primary authority or approaching the appropriate authority as illegal and arbitrary and for a consequential direction to the respondents to grant assignment to the petitioners in respect of the aforesaid lands which they have in possession.
Learned Assistant Government Pleader for Assignments states that resumption orders are passed against the petitioners under A.P.Assigned Land (Prohibition of transfer) Act, 1977.
Learned counsel for the petitioners submits that the resumption orders are not served on the petitioners. In view of the above, the 4th respondent is directed to serve a copy of the resumption orders to the petitioners enabling them to challenge same, within a period of one week from the date of receipt of a copy of this order. Till then Stutus quo obtaining as on today shall be maintained.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
