HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19402 OF 2016 ORDER:

The case of the petitioners is that they have purchased the land admeasuring Ac.0.73 cents out of Ac.1.49 cents from the sons of one B.Ahammed Hussain through 3 different sale deeds. The said Ahammed Hussain has purchased the said land on payment of market value at Rs.1,000/- per acre, totaling to an amount of Rs.1,490/- at the time of assignment. The petitioners were in joint possession of the subject land till today. But, the petitioners with an intention to make partition of the said land, submitted the documents to registration authorities for registration of partition agreement.

But the registration authorities refused to receive and register the said documents on the ground that the subject land is included in the prohibited list of properties for registration and also insisted for production of No Objection Certificate from the revenue authorities. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioners submits that earlier when W.P.No.24448 of 2012 was filed in respect of the same land, this Court vide order dated 08.08.2012 allowed the writ petition with a direction to the registration authorities to register the document presented by the petitioner therein holding that since the subject lands was assigned on payment of market value, the provisions of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 has no application.

Heard the learned Assistant Government Pleader for Stamps and Registration.

Since already there is a finding in W.P.No.24448 of 2012 that the subject lands are assigned on payment of market value, this writ petition is also disposed of following the order dated 08.08.2012 in W.P.No.24448 of 2012.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.
