THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.624 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following order is passed:

Learned counsel for the petitioner submits that the allegations made in the F.I.R do not attract any of the charges either under Section 354A IPC or Section 354D IPC in as much as even if the allegations are taken to be true, the petitioner/accused, who is a Religious Preacher, has had no physical contact with the de facto complainant and he has not committed any offences and, therefore, the petitioner deserves quashment of the proceedings. Per contra, opposing the petition, the learned Public Prosecutor would submit that the statement of the victim girl recorded by the police reveal the overt acts committed by the accused under the guise of preaching her religious sermons and in view of it and investigation is still pending, this criminal petition may be dismissed. On a perusal of the statement of the victim girl, dated 21.01.

2015, a copy of which is produced by the learned Public Prosecutor, this Court is of the considered view that there is a prima facie material against the petitioner/accused and, therefore, it is not a fit case to quash the proceedings. Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
