THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36676 OF 2015 O R D E R :
The grievance of the petitioner in this writ petition is that his Fair Price Shop dealership authorization has been suspended by the impugned order dt.13.10.2015 of the 4th respondent without conducting any enquiry into the allegations mentioned in the show cause notice dt.21.08.2015, to which he submitted explanation on 07.09.2015.
2. Petitioner contends that even though one month has elapsed since suspension, there is no indication as to when the enquiry will be completed and that keeping the petitioner's dealership under suspension indefinitely would be arbitrary.
3. A Division Bench of this Court in The Joint Collector, Kurnool v. A. Neelima followed in D. Sambasiva Rao vs Joint Collector And Ors and M.Venkata Ramaiah v. Joint District Collector (CS), Anantapur District and others has taken a view that period of suspension of a fair price shop dealership ought not to ordinarily exceed beyond 90 days, since the period of 90 days is reasonable period for concluding the enquiry into the allegations against a fair price shop dealer.
4. In this view of the matter, the Writ Petition is disposed of directing the 4th respondent to complete the enquiry initiated against the petitioner pursuant to the show cause notice dt.21.08.2015 on or before 12.01.2016. There shall be no order as to costs.
5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
