ORDER:
This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.3, in considering the proposal of respondent No.6, vide proceedings No.HCL/Director/Mee-Seva/2015-16/AP56, dated 26.11.2015, as illegal and arbitrary.
The petitioners pleaded that the State Government
has been extending various services to its citizens through Mee Seva Centers; that in this regard, it has issued G.O.Ms.No.45, dated 09.10.2012, laying the guidelines for establishing new Mee Seva Centers on need basis;
that following the judgment, dated 31.10.2013, of this Court in Writ Petition No.21959 of 2013 and batch, filed challenging the said G.O., the State Government has issued Memo No.13/PD EGov/2013, dated 01.01.2014; and that respondent No.6 is the authorised service provider for urban areas in SPSR Nellore District. The petitioners further pleaded that as per the prescribed procedure, the Government will appoint the franchisees selected and recommended by respondent No.6. They further pleaded that respondent No.6 has considered and selected them as franchisees of Mee Seva Centers in terms of Clause-11 of G.O.Ms.No.10, Information, Technology & Communications (Infrastructure) Department, dated 18.10.
2011 and that they were also imparted one week training in the month of October at Nellore city for acquainting them with the programmes for running the Mee Seva Centers. That on 26.11.2015, respondent No.6 has addressed a letter to respondent No.3 requesting him to appoint the 19 persons named therein as franchisees of Mee Seva Centers in SPSR Nellore District. The grievance of the petitioners is that in spite of the said communication, respondent No.3 has not been taking any action.
Learned Government Pleader for Information and Technology (Andhra Pradesh) has fairly agreed that as per the scheme in force, the service providers select the franchisees and the recommendations made by them for appointing the selected persons as franchisees will be considered by respondent No.3.
In the light of the above facts and circumstances of
the case and the submissions of the learned Government Pleader as noted above, respondent No.3 is directed to consider the proposal of respondent No.6 made on 26.11.205 for appointing the petitioners as franchisees of Mee Seva Centers in SPSR Nellore District, take a decision and communicate the same to the petitioners within three weeks from the date of receipt of a copy of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.1788 of 2016 shall stand disposed of as infructuous.
