Heard the learned counsel for petitioner and Sri N.Siva Reddy, learned Standing Counsel for the respondents.
2. Petitioner has assailed proceedings 27-03-2018 issued by 3rd respondent provisionally assessing civil liability of the petitioner as Rs.2,80,294/- with an allegation that the petitioner indulged in theft of energy by pilferage.
3. Since the civil liability is to be assessed by the Special Court under the Electricity Act, 2003, subject to the petitioner paying 50% of the provisionally assessed amount, after giving credit to the amounts already recovered from the petitioner in regard to the said liability within six weeks from today, the power connection to the petitioner's service connection shall be restored and the 1st respondent shall refer the matter for determination of civil liability to the Special Court under Section 154 (5) of the Act and the same shall not be disconnected till the determination of civil liability by the Special Court.
4. Accordingly, the Writ Petition is disposed of. No costs.
5. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
