HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10386 OF 2016 ORDER:

It is the case of the petitioner that petitioner is an ExService men and he was assigned land to an extent of Ac.02-50 cents in Sy.No.122/1B and an extent of Ac.0250 cents in Sy.No.122/1D, totally admeasuring Ac.5-00 cents situated at Gudimallam Revenue Village, Yerpedu Mandal, Chittoor District, vide DKT No.282/4/1415, dated 02-08-2005 with a condition not to alienate the land for a period of 10 years. On 03-08-2015, the locking period expired. After that the petitioner intended to alienate the property made application on 02-01-2016 before the respondents 2 and 4 for grant of 'No Objection Certificate' (NOC). No orders are passed on the same and the petitioner presented the documents before the 5th respondent for issuance of market value, but he refused to give market value insisting NOC. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that as per GO.Ms.No.1117/1993, dated 11-11-1993, the petitioner can sell away the lands after locking period is over.

On the other hand, learned Assistant Government Pleader for Revenue produced a copy of GO.Ms.No.307, dated 06-06-2013 stating that no objection must be

produced from the District Collector.

A perusal of G.O.Ms.No.307, dated 06-06-2013 shows guidelines mentioned thereunder are subject to final outcome of W.A.No.352 of 2013. Now both counsel stated that W.A.No.352 of 2013 is disposed of by Full Bench of this Court on 23-12-2015 along with W.A.No.343 of 2015 and Batch.

In view of the same, this writ petition can be disposed of in terms of order passed by Full Bench of this Court in the above writ appeal.

In view of the facts and circumstances of the case, the writ petition is disposed of in terms of Full Bench order of this Court in W.A.No.352 of 2013, which was disposed of along with W.A.No.343 of 2015 and Batch.

In view of the same, the writ petition is disposed of in terms of order dated 23-12-2015 passed by Full Bench of this Court in W.A.No.352 of 2013, which was disposed of along with W.A.No.343 of 2015 and Batch. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
