THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.M.A.No.1273 of 2012 ORDER:

On reference to the Lok Adalat, the Lok Adalat passed the following Award dated 13.8.2016.

"The above Case between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case/matter, the following Award is passed in terms of the settlement.

1. Sri Akshay Kulkarni, Legal Officer, ICICI Lambard General Insurance Company Limited and Smt. Chayadevi, learned counsel for the Respondent/Applicant. Both the parties are present.

2. It is stated that both the parties have amicably settled their dispute and in pursuance of the compromise between them, the applicants agreed to receive Rs.3,00,000/- as against the awarded amount of Rs. Rs.4,14,567/- in full quittance against the Insurance company.

3. It is stated that the insurance company has already deposited the entire amount as per the award.

4. Accordingly, the award is passed for the above said amount of Rs.3,00,000/- in favour of the applicants in full quittance of their claim against the insurance company and the applicant is entitled to receive the same together with accrued interest, if any, thereon. The Insurance Company shall be entitled to refund of Rs.1,14,567/- along with accrued interest thereon, if any.

5. The applicants are permitted to withdraw entire amount.

6. In terms of the compromise arrived at between the parties, this case is disposed of.

7. The parties are informed that the court fee, if any, paid by any of them before lower court shall be refunded."

In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the CMA stands disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 21.9.2016 DA
