This petition is filed for a writ of Mandamus declaring the action of the respondents in not considering the claim of the petitioner for notional seniority on par with his batch mates, as illegal and arbitrary and for a consequential direction to the respondents to consider the claim of the petitioner for assigning the notional seniority on par with his batch mates w.e.f.17.08.2005 by extending the orders passed by the Tribunal in OA.No.858/2010 and batch, dated 07.09.2011 which was implemented by the Government in G.O.Ms.No.32 (Home Department) dated 13.02.2014 with all consequential benefits (i.e. Monitory benefits, Increments, Seniority).

Learned counsel for the petitioner submits that the petitioner has submitted representation dated 16.02.2010 in respect of his grievance in the writ petition to the 4th respondent and the same is not being disposed of. He further submits that in similar circumstances the A.P.Administrative Tribunal, Hyderabad, disposed of OA.No.858 of 2010 and batch on 07.09.2011.

Both the counsel submit that the writ petition can be disposed of.

Since the representation of the petitioner is stated to be pending before the 4th respondent, without expressing any opinion on merits, the writ petition is disposed of, directing the 4th respondent to dispose of the representation of the petitioner dated 16.02.2010, in accordance with law, by taking into account the order passed by the Tribunal in OA.No.858/2010 and batch and take action accordingly. No order as to costs.
