WRIT PETITION NO. 9174 OF 2012 O R D E R :
The learned counsel for petitioner after perusing the report dated 25/09/2012 drawn by in the presence of petitioner as well by State Bank of India submits that relief prayed for in the writ petition does not survive. The occasion to operate locker arisen had there been articles in the locker or that the petitioner is interested in continuing to operate the same. From the report dated 25/09/2012, it is evident that except the adoption deed dated 13/05/1985, no other article/item was found in the locker.
2. Having regard to these circumstances, the learned counsel for petitioner requests the court to permit the petitioner to grant liberty to make a representation for cancelling the locker and refunding the deposit made in this behalf.
3. The request appears to be reasonable. The petitioner is given liberty to make such a request and the Bank is directed to consider and pass appropriate orders within a period of four weeks
from the date of receipt of copy of the representation, bearing in mind the observation of this court in WP.No.19628 of 2011.
4. The writ petition is disposed of. No order as to costs.
5. As a sequel, Miscellaneous Petitions if any, pending in this writ petition shall stand closed.
