THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.10534 OF 2015 ORDER:
The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not closing the Suspect Sheet No.42 of 2006 opened against the petitioner even though no cases are pending by considering the representations dated 05.01.2015 and 09.03.2015 as illegal and arbitrary, and consequently to direct the respondents to close the suspect sheet opened against the petitioner.
Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner was falsely implicated in one case in 2006 and the same was ended in acquittal of the petitioner. He further submits that except the said case, no other case was registered and pending against the petitioner and as such, the petitioner made applications dated 05.01.2005 and 09.03.2015 for closure of the suspect sheet and that the respondents did not close the suspect sheet. Hence, he prays this Court to direct the respondents to close the rowdy sheet against the petitioner. Considering the facts and circumstances of the case, the petitioner is directed to make a fresh representation to the respondents 2 and 3 stating all the reasons seeking for closure of the suspect sheet and on filing of such application, the respondents 2 and 3 are directed to consider the representation and pass appropriate orders as expeditiously as possible, preferably within a period of two months from the date of application of the petitioner. Further, the respondents 2 and 3 are directed not to compel the petitioner to come to the Police Station.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
