Heard the counsel for petitioner, and the learned Government Pleader for Revenue, for respondents. 2.

The petitioner had applied in Form VI (A) on 16.02.2016, under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1974, to the 2nd respondent for issuance of pattadar pass book and title deeds in respect of the subject land.

3. The 2nd respondent had issued an endorsement on 10.03.2016 stating that petitioner did not pay fee under Right to Information Act, 2005 and therefore his application in Form VI (A) filed under the above Act is rejected.

The learned Government Pleader for Revenue (Andhra Pradesh), appearing for respondents, is unable to explain how the impugned rejection order could be passed on the ground that a certain fee, payable under the Right to Information Act, 2005, is not paid by petitioner when the petitioner's application is in Form VI (A) under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1974 and not under the Right to Information Act, 2005.

Therefore, the impugned endorsement dt.10.03.2016 is quashed and the 2nd respondent is directed to pass a fresh order within a period of four (04) weeks from the date of receipt of a copy of this order stating why he does not wish to accept the petitioner's request for grant of pattadar pass book and title deed, and communicate the same to petitioner.

6. Accordingly, the Writ Petition is allowed as above. No order as to costs.
